Agreement to Terms
By accessing or using the Reed Welton website and services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our website or services.
Services
Reed Welton provides custom metal fabrication services including:
- Custom metal sculptures and artwork
- Functional metalwork (railings, gates, furniture, etc.)
- Restoration and repair services
- Industrial welding services
Project Quotes and Contracts
Quotes
All quotes are estimates based on information provided by the client. Final pricing may vary if project scope changes or unforeseen complications arise. Quotes are valid for 30 days from the date provided.
Project Agreement
A detailed project agreement will be provided for all custom work, outlining scope, timeline, materials, pricing, and payment terms. Work begins only after client approval and receipt of deposit.
Payment Terms
- A 50% deposit is required to begin work on most projects
- The remaining 50% is due upon project completion before delivery/installation
- Large projects may have milestone-based payment schedules
- Accepted payment methods: Venmo, Zelle, PayPal, check, bank transfer
- Late payments may result in project delays or cancellation
Client Responsibilities
Clients agree to:
- Provide accurate project information and requirements
- Provide timely feedback and approvals
- Ensure proper site access for installation if applicable
- Obtain any necessary permits or approvals
- Provide complete and accurate contact information
Delays in client responses or materials may extend project timelines.
Timeline and Delivery
Estimated timelines are provided in good faith but are not guarantees. Timelines may be affected by material availability, weather, complexity, and client feedback. We will communicate any significant delays promptly.
Changes and Revisions
Most projects include up to 3 rounds of design revisions. Significant changes to project scope after work has begun may result in additional charges and extended timelines. All changes must be approved in writing.
Cancellation and Refunds
- Either party may cancel with written notice
- If client cancels after work has begun, the deposit is non-refundable
- The deposit compensates for time, planning, and materials already invested
- Completed work beyond the deposit value will be billed at agreed rates
- If we cancel, all payments will be refunded in full
Intellectual Property and Ownership
Client Content
Clients retain ownership of all content they provide (images, designs, descriptions). By providing content, clients grant us permission to use it for the specific project.
Completed Work
Upon full payment, clients receive ownership of the completed physical piece. Clients may use, modify, or transfer ownership of the piece. However, we retain rights to use project photos for portfolio, marketing, and promotional purposes unless otherwise agreed in writing.
Reusable Components
We retain ownership of reusable frameworks, templates, techniques, and processes not unique to client's specific design. This allows us to apply learned skills to future projects.
Warranty and Liability
Workmanship Warranty
We warrant the quality of our workmanship for one year from project completion. This covers defects in welding, fabrication, and structural integrity resulting from our work. The warranty does not cover normal wear, damage from external causes, or inadequate maintenance.
Limitation of Liability
We make no guarantees regarding business outcomes, aesthetic preferences, or subjective satisfaction. Our total liability shall not exceed the total amount paid for the project. We are not liable for indirect, incidental, or consequential damages.
Third-Party Services
We are not responsible for third-party service failures including shipping damage, material supplier issues, or hosting/domain service outages beyond our control.
Content Responsibility
Clients represent that all provided content is owned by them or properly licensed. Clients are solely responsible for content legality and accuracy. Clients agree to indemnify us against any claims arising from client-provided content.
Safety and Compliance
All work is performed following industry safety standards and local building codes. For structural or load-bearing installations, clients are responsible for obtaining any required engineering certifications or permits. We can assist in coordinating these services when needed.
Photography and Portfolio Use
Unless specifically agreed otherwise, we reserve the right to photograph completed projects and use these images in our portfolio, website, social media, and marketing materials. Client names and locations will not be shared without permission.
Dispute Resolution
In the event of a dispute, both parties agree to first attempt to resolve the matter through good-faith negotiation. If negotiation fails, disputes will be resolved through mediation or, if necessary, in the courts of Oregon.
Modifications to Terms
We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting to the website. Your continued use of our services constitutes acceptance of modified terms.
